The minimum wage is set each year and affects the pay of millions directly. But its reach is wider than pay: it is the floor for severance ceilings, maintenance assessments, administrative fines and the limits on attachment.
For 2026 the gross minimum wage is 33,030.00 TL. Below: where the difference between gross and net comes from, the total cost to the employer, and the other rights that depend on it.
Gross and Net
The gross wage is the total the employee has earned. The net is what remains after the statutory deductions:
- Employee's social security contribution;
- Employee's unemployment insurance contribution;
- Income tax — an exemption applies at minimum wage level;
- Stamp duty — also exempt at minimum wage level.
Because of the tax exemption at that level, the net is found by deducting only the insurance contributions from the gross. The exemption also applies to the portion of a higher salary that corresponds to the minimum wage.
The Cost to the Employer
The employer pays more than the gross wage: the employer's share is added on top —
- The employer's social security premium;
- The employer's unemployment insurance contribution.
Employers benefiting from incentives may pay lower premium rates, depending on the sector and the position of the business.
The distinction matters in practice: establish at interview whether the figure discussed is gross or net. Whichever figure is written into the contract is what governs any later severance and notice pay calculation.
What Else It Governs
- The severance ceiling is set separately, but is updated twice a year alongside the minimum wage.
- The exemption limit in salary attachment — the portion left to the employee for subsistence.
- Maintenance assessments — courts frequently use the minimum wage as a reference.
- Unemployment benefit upper and lower limits.
- Ability to pay in the assessment of judicial fines.
A change in the minimum wage therefore affects far more than minimum wage earners.
Can Less Be Paid?
No. The minimum wage is a mandatory floor; a lower wage cannot be agreed even with the employee's consent, and any contractual term to that effect is void.
Two situations arise in practice. The first is a payslip showing the minimum wage while a higher wage is paid in cash; this damages the employee's severance and pension rights directly. The second is part of the wage simply not being paid.
In both cases the route is open: a declaration of the real wage can be sought. Bank records, witness evidence and a survey of comparable wages decide these cases.
Non-payment of wages also gives the employee the right to terminate for just cause (İş K. art. 24/II-e), and severance pay arises on such a termination.
The wage written into the employment contract is what governs any later severance and notice calculation. If you are in fact paid more than the payslip shows, that gap reduces your severance and pension rights directly. Ask to be paid through a bank.
